Every employer has a safety obligation towards its employees. On March 31, 2022, the law of August 2, 2021 will come into force, which aims to strengthen the prevention of professional risks in companies.. The Absolute Human Resources working group explains how to respond to the new constraints linked to the establishment of the Single Professional Risk Assessment Document (DOUBLE).

This law will come into force on March 31, 2022, subject however, for certain provisions, the publication of implementing decrees or specific dates. What is it about ? The DUERP is a summary document that allows risks to be identified, both physical and psychological, to which workers are exposed, prioritize them, and put in place preventive measures. The aim is to improve the working conditions of employees. Who is affected by this obligation? ? All employers are affected, whether in the private or public sector, regardless of the size of the company, the number of employees and the sector of activity. The table below shows their new obligations. Note that the control of staff and worker representatives over the development of the DUERP is reinforced.

What sanctions are planned ?
These can be criminal if the employer does not transcribe or does not update the DUERP (he is liable to a fifth class fine) ; or if he is guilty of an offense of obstructing the functioning of the Social and Economic Committee (CSE) if the latter is not consulted. They can also be civil in the event of an action for damages for the employee demonstrating damage..
