Unsold non-food items : the anti-waste aspect of the AGEC law little known to businesses

Seven out of ten respondents are not aware of the entry into force of the prohibition on destruction of non -food unsold. Only 2 % of companies declare to succeed in valuing all their unsold new non -food, revealing that the destruction of unsold is still practiced despite the legal obligation. Less than one in two respondents (49 %) declares that all unsold new people are affected by law, which reveals a ignorance of the typologies of products actually affected by law. There are 42 % to declare that it is either impossible, be difficult for them to envend their unsold, emphasizing the fact that brakes persist in companies. Companies, however, 58 % recognize that this is an "important subject" in the current context of inflation and stake of margins.

Valuation : The three r ignored

The other responses show a deficit in knowledge of the scope of application of the law and the typology of the products concerned. So, 79 % of companies do not know the hierarchy of valuation of unsold : re-use, reuse, recycling. "The Agec law covers very wide themes (plastic, displays, Consumers ...) and the different components of the law are implemented gradually. Law difficult to apply ?
Despite the legal ban, The destruction of unsuccessful non -food in companies in 2022 is still very practiced : 7 % of companies still say destroy their unsold new and 16 % their unsuccessful but still functional unsold it which joins the figure of the ADEME of October 2021. Only 17 % of companies valued more than 50 % of their unsold. Companies say they are faced with real difficulties in enveting unsold. Defective but functional unsold people seem to present the most important recovery difficulties : 57 % of companies their valuation impossible or difficult. On the component of re -use and donations to associations, 71 % of companies say they are having difficulty donating associations, For reasons of complexity of identification of the sectors, For lack of time or for lack of reliability of collections. Half of the companies still plan to accelerate their valuation strategy for non -food unsold in 2023. Before the Agec law, The majority of companies questioned claim that they had already implemented valuation actions, 35 % systematically and 51 % occasionally. They were only 14 % to have nothing. For 23 % of companies, The Agec law was a real accelerator of change.

The perception of the Agec law
The Agec law is an opportunity for 49 % and a constraint for 21 % of companies. Half (50 %) declares that it has registered the valuation of non -food unsold as a priority action in their 2023 strategy, But 20 % believe that this is not a strategic issue. "There is still a long way to go in the awareness of non -food waste in companies as well as in the public sphere. If the business model has been, always, to be very well organized for the sale of new products, The antigaspi component of the Agec law now undertakes them to manage and guide new flows of unsold or unsold products to donations or second -hand resale. The implementation of these new management practices and these new processes is sometimes complex and time -consuming ", explains Pierre-Yves Pasquier.
